July 30,2007 -- This article in today's edition of The Washington Times, Virginia's bid for help with illegals nixed, is a huge story! Don't let its length fool you.

For the longest time I have been steadfastly refuting the reasoning (or lack thereof) when the President and other open borders advocates such as Ted Kennedy, John McCain and all of the other "Usual Suspects" declare that we have tried an enforcement only approach to immigration and that this approach has not worked. As I am sure you know, I have stated that all that "We the People" have been provided with has been an illusion of enforcement and it is the illusion that has failed to deter illegal immigration and restore integrity to the utterly dysfunctional immigration system.

When, on those rare occasions special agents of ICE conduct a raid at a factory or other employment location where many illegal aliens are believed employed, the news media often responds by sending reports, cameras and microphones. This is news worthy because those raids are so rare. When I was working for the INS the only time that the news media would even ask about what we were doing was when we arrested many illegal aliens or when there was an additional aspect of interest involved. Today, even when only a relative handful of illegal aliens are arrested, reporters show up. The open borders advocates attempt to play on the sympathy of the kind-hearted American people by talking about the fact that many of the illegal aliens who are arrested have children. Law violators are, indeed, often parents of young children, but that generally does not prevent law enforcement from doing its job. This argument is often all that the open borders activists can use as a supposed issue.

In the case of violent felons who are, in fact, aliens illegally present in the United States, it becomes a far more difficult "sell" to attempt to play on the sympathy of anyone where drug traffickers, burglars and assorted other criminals and thugs are concerned. Yet, because the resources at ICE are so sparse, criminal aliens are often not taken into custody to remove them from the United States. So while communities are signing up to have their local law enforcement officers receive the requisite training under Section 287(g) of the Immigration and Nationality act to enable them to properly determine the immigration status of an alien they encounter during the course of their official duties, it would appear that often the effort does not result in the desired ultimate effect of having criminal aliens removed from the United States to protect communities around the United States.

On April 7, 2005 the GAO issued a report at the behest of then Chairman of the House Subcommittee on Immigration, Border Security and Claims, John Hostettler along with members of that subcommittee, Representatives Melissa Hart and Steve King. Representative King is currently the ranking member of that subcommittee. The subject of the report was, Information on Criminal Aliens Incarcerated in Federal and State Prisons and Local Jails.

The report made the point that, "Four States Spent About $1.6 billion to Incarcerate SCAAP (State Criminal Alien Assistance Program) Criminal Aliens in Fiscal Years 2002 and 2003." The four states were California, Florida, New York and Texas. These states were reimbursed the costs of the incarceration of those criminal illegal aliens.

The report makes many other significant points about the growing problem of criminal aliens. By not having the resources to deport all of the criminal aliens, the issue of recidivism rears its ugly head. When criminal aliens are not deported upon the completion of their criminal sentences, they are released into our communities around the United States where they then go on to victimize still more innocent people.

On many occasions, the administration has failed to hire as many immigration enforcement personnel as authorized by the Congress.

On March 10, 2005 I was called as a witness before a hearing conducted by the House Judiciary Committee, Subcommittee on Immigration, Border Security and Claims to testify at a hearing entitled, Interior Immigration Resources. This hearing made it clear that the resources to get the job done were utterly lacking and little was being done to remedy the situation.

As I have stated on many occasions, "Dead is dead!" To the victim of a violent crime and his (her) family, that victim is no less dead than a victim of an act of terrorism. The number one job of a government is to protect the well being of its citizens. When a government fails at this most basic and fundamental mission, little else matters. When a nation is a "Super Power" the lack of resources, obviously resulting from a lack of political will is all the more vexing and tragic.

The federal government is supposed to secure the borders of the United States and create an immigration system that possesses integrity. It is common knowledge that America's borders are anything but secure. Border Patrol agents who attempt to do their jobs seemingly risk arrest and prosecution as exemplified by Border Patrol Agents Ramos and Compean. Our nation has broadcast a clear message to people all over the world including, undoubtedly criminals and terrorists. That message is that the United States lacks the resources and the will to keep such malevolent individuals out of the United States and that we also lack the resolve to deport many of those who are arrested and convicted of committing felonies.

My dad used to tell me that we teach people how we expect to be treated. The criminal aliens are getting one hell of a lesson!

We the people need to put our elected representatives on notice!
